These Terms of Service ("Agreement") govern your use of the Fedev EU VAT & VIES Shopify app ("the App"), provided by MB Fe dev ("we," "us"). By installing, accessing, or using the App, you ("you," the merchant operating the Shopify store) agree to be bound by this Agreement, our Privacy Policy, and our Data Processing Addendum, both of which are incorporated into and form part of this Agreement. If you don't agree, don't install or continue using the App.
This Agreement is between you and us. It doesn't replace, and is separate from, any agreement between you and Shopify.
The App checks a buyer-supplied EU VAT number against the EU Commission's VIES registry at checkout, and where it validates, causes Shopify's native tax-exemption mechanism to apply the cross-border B2B reverse-charge VAT exemption. It also keeps a record of each check for your own audit purposes, as described in our Privacy Policy.
Any paid plan you select in the App is billed through Shopify's Billing API, under Shopify's own billing terms. Cancelling a paid plan reverts your store to the free tier; it doesn't delete your data, which continues to be handled per our Privacy Policy.
How we handle personal data your customers and your store generate through the App is set out in full in our Privacy Policy and Data Processing Addendum, both incorporated into this Agreement by reference.
The App is provided "as is," without warranties of any kind. VIES is a third-party EU government service outside our control; we don't guarantee it will always be available or return an answer, and the App is built to allow the order to proceed (with the VAT kept and the result flagged for your review) when it doesn't. We don't warrant that the App will be uninterrupted, error-free, or fit for a particular purpose.
To the maximum extent permitted by law, our total liability arising out of or relating to this Agreement or the App is limited to the fees you paid us for the App in the 12 months before the claim arose, and we're not liable for indirect, incidental, or consequential damages, including lost profits or lost tax exemptions. Nothing in this Agreement limits liability that can't be limited under applicable law.
This Agreement takes effect when you install the App and continues until you (or we) end it. You can end it at any time by uninstalling the App. We may suspend or end the App's availability to you if you materially breach this Agreement. What happens to your data when the Agreement ends is set out in our Privacy Policy.
If we make a material change, we'll update the effective date above and, where required, notify you through the App or by email.
This Agreement is governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law principles.
